An examination of State immunity by the Scottish Courts
Chris Stephen has a case comment in the new issue of the Scots Law Times entitled “An examination of State immunity by the Scottish Courts” S.L.T 2022, 39, 265-268. This discusses the recent case of Morrison v Mapfre Middlesea Insurance Plc where both the Outer House (2022 S.L.T. 412) and Inner House of the Court of Session (2022 S.L.T. 1131) had to determine whether a third party, the Authority for Transport in Malta, was immune from the jurisdiction of the Scottish Courts under s.14(2) of the State Immunity Act 1978.
