Alternative Dispute Resolution

Effective representation has a role outside a courtroom. A persuasive advocate can add value in other forms of dispute resolution. Themis members have experience of representing clients in arbitrations, mediations and expert determinations. Our advocates can draw on specialist qualifications and experience as regulatory tribunal chairs and part-time judicial office holders to provide both representation; and to determine disputes. Some of our members have been invited to conduct inquiries and chair investigatory committees.

Clear advice and robust advocacy are the benchmarks of counsel practising in commercial matters. Themis members have a reputation for both. Our members’ experience of the broad range of client commercial contract disputes, building and construction matters, restructurings and corporate breakdowns, and banking and agency issues amongst others, together with the stable’s ability to offer counsel across the range of seniority, offers reassuring support for those engaged in commercial life.

Crime

Our counsel engaged in criminal law matters value fearless and determined advocacy. Whether defending criminal charges, appealing convictions, opposing applications for the recovery of proceeds of crime, careful and thorough preparation and robust and compassionate advocacy can be expected. Our members also bring their experience to bear in regulatory proceedings and health and safety matters.

Employment

Themis’s offers a group of practitioners with experience advising and representing both employers and employees in all aspects of employment law. With leading practitioners in their field, our employment counsel represent clients at all levels, form the Employment Tribunal, through the EAT, the Court of Session and the UK Supreme Court. In addition to representation, our counsel provide advice on handling internal employment and regulatory issues for employers and employees.

Family

Themis members offer a wealth of experience at all levels whilst offering empathetic insightful and pragmatic independent advice and representation in family law matters. Whether in relation to public law child concerns including adoption and children hearings, private law child issues such as care and financial support, or provision for older family members, our counsel strive to provide client focused results.

Land and property

Our counsel have expertise across many aspects of land ownership, lease and land development issues. In the specialist forums of the Lands Tribunal for Scotland and the Land Court and in the Commercial Courts and others, members bring their skills to the resolution of boundary disputes, title restrictions, compulsory purchase orders, lease obligations and other disputes and challenges. Members are able to offer comprehensive advice in addition to effective representation.

Negligence

Whatever the claim, our counsel can offer advice and representation in all aspects of professional negligence and other damages claims. Our members have experience of both pursuing and defending actions of high value and complex formulation, and can draw on that experience across the board to offer insightful and practical advice.

Public Law

The development of judicial review as a means of regulating decision-makers of all kinds in recent decades, the establishment of the Scottish Parliament, and the coming into force of the Human Rights Act have greatly increased the need for reliable, effective and professional advocacy and advice about the law governing relations between the individual and the state and other organisations.
