Private Enforcement of Competition Law - Seminar, Thursday 1st February
For many years the European Commission and the CMA have encouraged the use of competition law by private parties to bring their own cases in the courts; e.g., for interdicts or damages an unfair concerted practices or abuse of a dominant position. But there are barriers to such use. The main obstacle is costs. Characteristically defenders have deeper pockets than possible pursuers. The seminar explores possible solutions. Michael Upton will speak about the law and procedure, Frances Sim about funding options, as follows:-
Private Enforcement of Competition Law
Procedure
• Grounds for actions & remedies
• Costs & liability caps
• Group actions
• Law in action: cases
Funding
• How third party funding works in practice
• A case study
• Benefits to the client and legal team
• Likely costs
Michael’s knowledge of the topic goes back to specializing in it for his Master’s at the E.U.’s University at Florence; Frances’ experience is seven years of funding cases in the U.K. market.
