Themis Member Michael Upton acted for the successful respondents in the First Division’s refusal of the Royal London Mutual Insurance Society’s appeal in its case against Chisholm Hunter Ltd. and others on 19 July. Mr. Upton also acted for the respondents at first instance when the Lands Tribunal last year dismissed most of Royal London Mutual’s application to have common-repairs burdens struck down as unworkable. The litigation is about the régime of title conditions governing Argyll Chambers – the Buchanan Street part of Glasgow’s celebrated jewellery quarter, in the elegant, nineteenth-century Argyll Arcade. Royal London Mutual are the largest proprietor and objected to the share of common-repair costs which their fellow proprietors have now successfully established that they should pay.
